Countering the trafficking and distribution of synthetic drugs, whether on the Clearnet or the darknet, requires a dedicated team of investigators and specialists. It is important that authorities invest in resources and strategies to identify vendors selling synthetic drugs online and deploy dedicated units to monitor online marketplaces on a continuous basis.

Furthermore, authorities need to remain informed of current and evolving payment strategies, such as the use of cryptocurrencies. In addition, depending on the legislation of each Member State, open-source and undercover or covert techniques may be used to disrupt marketplaces on the Internet.

When conducting investigations involving several national, regional and/or international agencies, it is critical to share information, intelligence, and evidence. In addition, any chosen investigation strategy must be proportional, lawful, accountable, necessary and respect national and international jurisdictions. Moreover, investigations should be carried out in compliance with international human rights and privacy laws to prevent overreach by States and abuse of the process.
